The Village
Terms of Service
Last updated [CHECK: date of publication]
These terms cover the use of this website and the therapy services offered by Divya Berry Ltd, trading as The Village. Please read them alongside the privacy notice. Nothing here replaces the working agreement you and Divya will discuss and agree in your first session.
Who you are contracting with
Therapy at The Village is provided by Divya Berry Ltd, a company registered in England and Wales, company number [CHECK: company number], registered office [CHECK: registered office address]. Sessions are delivered by Divya C. Berry, MBACP, MBPsS, a Registered Member of the British Association for Counselling and Psychotherapy, membership number 385974.
Using this website
The content here is general information about a therapy practice. It is not clinical advice, not a diagnosis, and not a substitute for seeing a qualified professional about your own situation. No therapeutic relationship is created by reading this page or by sending an enquiry.
The text, photographs, logo and design of this site belong to Divya Berry Ltd and may not be copied or reused without permission.
If you need urgent help. This website is not monitored continuously and cannot be used in an emergency. If you are in crisis, contact your GP, call NHS 111, or call the Samaritans free on 116 123 at any hour. In an emergency call 999.
Booking and sessions
- Contact usually begins with a free introductory call of about ten minutes, at no charge and with no obligation.
- Sessions last fifty minutes and are held in person at the practice address, on Tuesdays between 4pm and 9pm.
- Work may be short term or open ended. This is agreed between you and Divya, and either of you may raise ending the work at any point.
- Therapy depends on regular attendance. A time is normally held for you each week.
Fees and payment
The fee is [CHECK: fee per session] for a fifty minute session, payable [CHECK: for example, by bank transfer before or on the day of each session]. Fees are reviewed [CHECK: for example annually, with a month's notice of any change].
[CHECK: state here whether any reduced fee places are held, and how someone asks about one. Delete this line if not.]
Cancellations and missed sessions
If you cannot attend, please give as much notice as possible. Sessions cancelled with less than 48 hours' notice are charged in full, because the time has been reserved for you and cannot usually be filled. Where possible Divya will offer an alternative time in the same week.
If Divya needs to cancel, you will not be charged, and an alternative time will be offered.
Planned breaks and holidays are discussed in advance on both sides.
Your right to cancel
Because arrangements are made at a distance, by phone or email, the Consumer Contracts Regulations 2013 give you fourteen days from agreeing to begin in which to change your mind and cancel, without giving a reason.
If you ask for sessions to start inside that fourteen day period, and you then cancel, you may be asked to pay for any session already provided. To cancel, email dcb@divyaberry.co.uk or call 07775 775913.
Confidentiality
What you bring to therapy is confidential, with the limited exceptions set out in the privacy notice: clinical supervision, serious risk to you or another person, and disclosures required by law. These are explained again at the start of the work.
Standards, and what to do if something goes wrong
Divya works to the BACP Ethical Framework for the Counselling Professions and holds regular clinical supervision and professional indemnity insurance.
If you are unhappy with any part of the service, please raise it with Divya directly first. Most concerns are best resolved by talking about them, and the conversation is treated as part of the work rather than as an interruption to it.
If that does not resolve matters, you may raise a complaint with the British Association for Counselling and Psychotherapy under its Professional Conduct Procedure, at bacp.co.uk. Complaints about how your personal information has been handled can go to the Information Commissioner's Office. Your legal rights under the Consumer Rights Act 2015, including the right to a service carried out with reasonable care and skill, are not affected.
Liability
Therapy is a collaborative process and no particular outcome can be promised. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Acceptable use
You are welcome to read this site, print it, and share the link. Please do not attempt to interfere with how it runs, gain access to anything that is not public, or use it for any unlawful purpose.
The words, photographs, logo and design belong to Divya Berry Ltd. Reproducing them elsewhere, or using them commercially, needs written permission first. Quoting a short passage with a link back is fine.
Availability and accuracy
Reasonable care is taken to keep this site accurate and available, but no site can be guaranteed to be error free or online without interruption. Practical details such as hours and fees change from time to time, and the version you are reading may not reflect the most recent change. If a detail matters to your decision, please confirm it on the introductory call.
Access may be suspended, withdrawn or changed without notice, for example while the site is being updated.
Links to other sites
This site links to Google Maps, the BACP register and divyaberry.co.uk. Those are run by other organisations. Linking to them is not an endorsement of everything they contain, and no responsibility is taken for their content or their handling of your data.
Changes to these terms
These terms may be updated. The date at the top of the page shows when they last changed, and the version published here is the one that applies. If a change affects work already under way with a client, it will be raised directly rather than left to be discovered on a web page.
If part of these terms does not hold
If any part of these terms turns out to be unenforceable, that part is treated as removed and the rest continues to apply.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
